Climate Litigation Update
Climate change litigation and the charge of ‘greenwashing’ has hit the Australian news this year several times, which makes our most recent Virtual Thought Leadership event on this topic very timely. If you missed the presentation and discussion between Elisa de Wit Partner, Norton Rose Fulbright and Dame Fiona Woolf DBE, DL. Energy Consultant, Former Partner, CMS Cameron McKenna on the status of climate change-related litigation. Elisa de Wit starts her presentation with an overview of litigation trends and statistics. While it is perhaps unsurprising that the US leads litigation in terms of numbers of cases, it is perhaps more surprising that Australia comes second. The initial wave of litigation cases were primarily against governments, however, increasingly cases are being brought against corporations and individuals.
In the presentation, Elisa outlines the key litigation themes or trends of these cases, before providing more detail on seminal cases. Given climate change litigation is going to be an increasing risk, particularly for large traditional energy firms, we hope you find this Virtual Thought Leadership discussion informative.
